Herbal Stock Images Terms of Service NOTICE: Please read these terms carefully before you continue to use the services offered on this website. The Herbal Stock Images ("HSI") service, including content as defined below, is made available to you, subject to your acceptance of the following terms and conditions. By accessing or otherwise taking advantage of the services of HSI, you accept all the following terms and conditions, including the limitations of use, liability and warranty set forth below. In these terms and conditions: 'HSI' means 'herbalstockimages.com'. 'You' means a party who uses or downloads the services of HSI in the form of digital image(s). 'Content' means all of the content made avaialble through HSI, including, but not limited to, digital images and all other text, graphics, photographs, images, moving images, sound and illustrations. 'Royalty-free images' means photographs and illustrations that are licensed to you according to the term of a royalty-free license agreement after you pay the applicable fee. 'Website' means the whole or any part of the web site pages located at http://www.herbalstockimages.com (including the layout of the Website, graphic design elements of the web site pages, underlying code elements and any text, graphics, sounds, animated elements or other content of the Website). 2. Prohibited use You will not use the HSI services, including the Content, for any unlawful purpose or for any purpose that is prohibited by these Terms of Service. This means that in using the HSI services you will not: (a) use the Content in the production of libelous, defamatory, fraudulent, lewd, obscene or pronographic material or any material that infringes upon any third party intellectual property rights or in any otherwise illegal manner (b) upload, post or otherwise transmit any viruses or other harmful, disruptive or destructive files (c) use or attempt to use another's account, password, credit card, financial or personal data (d) access or attempt to access any service or content which you are not authorised to access or (e) violate any applicable laws or regulations. 3. Limitation of liability HSI limits its liability to you. You may have certain rights and remedies available to you in relation to the provision by HSI of goods and services on the Website ("Basic Rights"). Except as provided by the Basic Rights: (a) all other conditions and warranties either express or implied by custom, law or statute are excluded (b) the digital image(s) we provide and all content on the Website is provided without any warranties of any kind, either express or implied, other than as we expressly state (for example, we expressly promise that we are entitled to license the digital images on the Website) (c) HSI does not warrant that your access to the Website or the functions contained on the Website will be uninterrupted or error free, that any defects will be corrected or that the Website or the server which stores and submits content to you via the Website are free of viruses, malicious computer code transmitted on or through the Website or other harmful components (d) HSI expressly disclaims the accuracy of all descriptions and specifications of any products displayed or viewed through the Website and (e) HSI expressly disclaims the currency, accuracy or completeness of any content or any information provided by third parties on or through the Website. Use of the Website is at your own
risk. Subject to these terms, you assume full responsibility and risk of
loss resulting from your downloading, use of, or access to data, files,
information, content, or other material on or through the Website. To
the extent permitted by law, under no circumstances will HSI be liable for
any damages whatsoever, whether direct, indirect, punitive, special, or
consequential damages, including (but not limited to) loss of profits,
loss of or damage to goodwill or other expectation benefit or liability to
any third party, that are directly or indirectly related to the use of, or
the inability to use, the website or any content provided on it or through
it, even if advised of the possibility of such damages or that such
damages were foreseeable. 4. Content Prices All Content prices are subject to change wihout notice. 5. Return Policy All royalty-free single images bought from HSI are non-returnative. All sales are final on images. 6. Ownership and Copyright The digital images and other content we provide on the Website is all subject to copyright belonging to us and/or to other people. Your use of the digital images or other content we provide or accessible through the Website does not grant you any ownership rights in these items. Except as permitted by law, you may not de-compile, reverse engineer, disassemble or otherwise reduce to human-readable form any software contained on the Website. 7. Termination HSI reserves the right to automatically terminate any license issued by it without notice if you or your employer fails to comply with any provision of this agreement or any license agreement issued by HSI. Upon termination, you and your employer must immediately stop using the Image(s), delete the Image(s) and all copies from all magnetic media and destroy all other copies. 8. Indemnity You agree to indemnify and hold HSI harmless from any and all claims, liabilities, damages, costs and expenses arising from the use of an image or any breach of this agreement. 9. Complaints HSI aims to resolve any grievance you may have before it gets to the stage of a complaint
